5 <br /> c) The successful bidder will be selected on the basis of criteria set <br /> forth in a Request for Qualifications which shall include price, <br /> experience, financial strength, and the quality of the proposed <br /> development; and <br /> d) The Request for Qualifications shall be in substantially the form <br /> provided to the City Council in draft form; and <br /> e) The development of the Property shall be carried out in a <br /> manner consistent with the objectives set forth in the City's <br /> Shoreline Master Plan; and <br /> f) The sale of the Property is subject to the City and the successful <br /> bidder negotiating and entering into a development agreement <br /> that details the nature and quality of the development and meets <br /> the requirements and conditions of the Request for <br /> Qualifications including the requirements of Everett Municipal <br /> Code Ch. 1929; and <br /> g) At such time as a bidder is selected as the "preferred <br /> developer", the bidder shall pay to the City a Fifty Thousand <br /> ($50,000) non-refundable deposit and enter into an exclusive <br /> negotiations agreement with the City; and <br /> h) The Property shall be sold to the most responsive and <br /> responsible bidder who meets these conditions and the criteria <br /> in the Request for Qualifications and is able to perform with the <br /> tender of U.S. funds at closing. Upon the request of the second <br /> and third highest responsive responsible bidders their bids <br /> remain active through the time period allowed for negotiation of <br /> the purchase and sale agreement, the delivery of funds, and the <br /> conveyance of property, and should the City and the preferred <br /> developer not be able to reach a final agreement, the next most <br /> responsive and responsible bidder shall be given an additional <br /> time period to negotiate the necessary agreement and to deliver <br /> the full cash sales price subject to paying the City a Fifty <br /> Thousand ($50,000) non-refundable deposit; and <br /> i) The City Council reserves the right to reject any and all bids. It <br /> also reserves the right to waive any informality in connection <br /> with said bids. <br /> j) The City may consider a long-term ground lease as an <br /> alternative to the purchase and sale of the property. <br /> 18 <br />
