5 <br /> RESOLUTION NO. <br /> A RESOLUTION declaring surplus certain Real Estate <br /> parcels located within the corporate limits of the City of <br /> Everett in the vicinity East of 1-5, south of 36th Street (generally <br /> known as the "Landfill and Simpson sites") and authorizing <br /> the sale thereof. <br /> WHEREAS, the Everett City Council finds and determines that the review of the <br /> following described properties has been completed by all City departments and <br /> approval to surplus the subject properties has been given by the Mayor; and <br /> WHEREAS, the Everett City Council finds and determines that the real property <br /> described in Exhibit "A" (Landfill Site) and Exhibit "B" (Simpson Site) is not and will not <br /> be needed for existing or foreseeable City purposes; and <br /> WHEREAS, the Everett City Council finds that the City has complied with the <br /> requirements of Section 15.8 of the City Charter and requirements of Resolution <br /> No. 1984, except as modified herein; <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF EVERETT as follows: <br /> Section 1: The real property described in Exhibit "A" (Landfill Site) and Exhibit <br /> "B" (Simpson Site) is not and will not be needed for City purposes and, <br /> therefore, is declared to be surplus property (the "Property"). <br /> Section 2: The Property shall be sold at a public sale by a competitive process <br /> on the following conditions: <br /> a) The final sale of the Property is subject to a binding purchase <br /> and sale agreement and development plan that has been <br /> approved by the City Council; and <br /> b) The Property shall not be sold for less than ninety (90) percent <br /> of the value as established by a written independent appraisal, <br /> which subject to City Council approval may be updated prior to <br /> the execution of the Purchase and Sale Agreement. <br /> i7 <br />
