5. IPMC 304.1.1 (8): The following conditions shall be determined as unsafe and shall <br /> be repaired or replaced to comply with the International Building Code or the <br /> International Existing Building Code as required for existing buildings: <br /> (8) Roof or roofing components that have defects that admit rain, roof surfaces with <br /> inadequate drainage, or any portion of roof framing that is not in good repair <br /> with signs of deterioration, fatigue or without proper anchorage and incapable of <br /> supporting all nominal loads and resisting all load effects. <br /> 6. IPMC 304.7: Roofs and drainage. The roof and flashing shall be sound tight and <br /> not have defects that admit rain. Roof drainage shall be adequate to prevent <br /> dampness or deterioration in the walls or interior portion of the structure. Roof <br /> drains, gutters, and downspouts shall be maintained in good repair and free from <br /> obstructions. Roof water shall not be discharged in a manner that creates a public <br /> nuisance. <br /> 7. IPMC 304.2: Protective treatment.All exterior surfaces, including but not limited <br /> to, doors, door and window frames, cornices, porches, trim, balconies, decks and <br /> fences, shall be maintained in good condition. Exterior wood surfaces, other than <br /> decay-resistant woods, shall be protected from the elements and decay by painting <br /> or other protective covering or treatment. Peeling, flaking and chipping paint shall <br /> be eliminated and surfaces re-painted. <br /> 8. IPMC 304.6: Exterior walls. All exterior walls shall be free from holes, breaks, and <br /> loose or rotting materials; and maintained weatherproof and properly surface coated <br /> where required to prevent deterioration. <br /> 9. EMC §8.20.020: No person owning, leasing, renting, occupying or having charge or <br /> possession of any property in the city, including vacant lots, shall maintain or allow <br /> to be maintained on such property except as may be allowed by any other city <br /> ordinance any of the following conditions visible from any public street, alley or <br /> other public or private property: <br /> (E) Dead, decayed, diseased, noxious or hazardous trees, or vegetation or any <br /> vegetation (not including vegetation located in flower beds) taller than forty-two <br /> inches high or grass taller than twelve inches in height in any front yard, side <br /> yard, rear yard or vacant lot. <br /> (F) Graffiti on the exterior of any building, fence or other structure in any front yard, <br /> side yard, rear yard or vacant lot. <br /> Conclusions of Law Based on Above Findings: <br /> 1. Primary Residential Structure: By failing to properly and adequately maintain the <br /> primary residential structure weather resistant and water tight, and allowing the <br /> structure to deteriorate and become dangerous and unfit for human habitation and <br /> become an attractive nuisance the Respondents have violated IPMC 108.1.5 (7) <br /> 6 <br />
