Exhibit 11 Exhibit List dated August 9, 2012 <br /> Exhibit 12a-12c Inspection Photos dated July 2, 2012 submitted by Ted Budden <br /> Exhibit 13a-13k Inspection Photos dated August 9, 2012 <br /> Exhibit 14 City of Everett Permit Application dated July 16, 2012 <br /> Based upon a review of the above record, the following Findings of Fact and <br /> Conclusions of law hereby constitute the basis of the decision of the Everett Violations <br /> Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Evertrust, Respondent, is the owner of record of property at 1611 24`h Street, <br /> Everett, Washington (property) and Peter Eriksen is the Trustee of the Trust. The <br /> property is in an R-3 Multiple-Family Medium Density zone. (Exhibit#9, Snohomish <br /> County Assessors Record dated August 8, 2012) (Exhibit#10, Go Sync Map) <br /> 2. On November 17, 2011 the City of Everett Violations Hearing Examiner found that <br /> several conditions on the property violated the Everett Municipal Code(EMC) and <br /> entered an Order requiring Walter Eriksen to abate the code violations. Mr. Eriksen <br /> was the owner of the property at the time of the November 17, 2011 Order. Those <br /> code violations are similar to the violations existing on the property today. It appears <br /> that Mr. Eriksen did not abate any of the conditions on the property that violated the <br /> EMC and were ordered by the City of Everett Hearing Examiner in an Order issued <br /> November 17, 2011. (Exhibit#7, Final Findings of Fact, Conclusions of Law and <br /> Order of the Hearing Examiner Case #CEI 1-0191 dated November 17, 2011) <br /> (Testimony of Code Enforcement Officer Wathen) <br /> 3. On July 2, 2012 Ted Budden, City of Everett Building Inspector, inspected the <br /> property and structures and observed conditions in violation of the International <br /> Property Maintenance Code. He observed a vacant and dilapidated residential <br /> structure and an attached accessory structure that was failing and in danger of <br /> collapse. (Testimony of Ted Budden) (Testimony of Code Enforcement Officer <br /> Wathen) <br /> 4. On July 9, 2012 the City of Everett Code Enforcement Unit referred the matter to the <br /> City Attorney's Office for further enforcement. Thereafter, research of Snohomish <br /> County Records revealed that Walter Eriksen no longer owned the property. A Quit <br /> Claim Deed was filed with the Snohomish County Auditor's Office on December 16, <br /> 2011. Ownership was transferred from Walter Eriksen to Evertrust and Peter Eriksen <br /> is the trustee.
