Third Amendment to the Memorandum of Agreement <br /> Between Central Puget Sound Regional Transit Authority and <br /> The City of Everett <br /> For Operations and Maintenance Services at Everett Station <br /> This Third Amendment to the Memorandum of Agreement between Central Puget Sound <br /> Regional Transit Authority and the City of Everett for Operations and Maintenance Services to <br /> Everett Station Agreement effective February 3,2002, (the"Agreement")is made by and between <br /> the CITY OF EVERETT("City")and CENTRAL PUGET SOUND REGIONAL TRANSIT <br /> AUTHORITY,a regional transportation authority of the State of Washington("Sound Transit") <br /> (together the"parties"). <br /> BACKGROUND <br /> A. The parties wish to amend the Agreement to add further language incorporating <br /> the presence of Sound Transit Ticket Vending machines both on the Commuter Rail platform <br /> and in the Great Hall of Everett Station and other equipment Sound Transit may wish to install at <br /> Everett Station in the future. <br /> B. Two prior amendments concerning the addition of maintenance services and <br /> other transit improvements shall remain in effect. <br /> AGREEMENT <br /> For and in consideration of the mutual covenants contained herein,the parties agree as <br /> follows: <br /> 1. Amendment to Section 3.1.1. Section 3.1.1 of the Agreement shall be amended with <br /> the addition of a new section 3.1.1.1 under 3.1.1 as follows: <br /> 3.1.1.1 Ticket Vending Machines on Platform <br /> The installation and maintenance of the Sounder owned Ticket Vending Machines, on the <br /> train platform, shall be the responsibility of Sound Transit. In the event the machines are <br /> removed from the platform, Sound Transit shall restore the platform, at its own expense, <br /> to a reasonable pre-installed condition, as determined by the City. <br /> 2. Amendment to Section 3.1.4. Section 3.1.4 of the Agreement shall be amended with <br /> the addition of a new section 3.1.4.1 under 3.1.4 as follows: <br /> 3.1.4.1 Ticket Vending Machines in Building <br /> The installation and maintenance of the Sounder owned Ticket Vending Machine, in the <br /> Great Hall of the Everett Station Building, shall be the responsibility of Sound Transit. <br /> In the event the machine is removed from the building, Sound Transit shall restore the <br /> 50 <br /> H:\Everett Sta OM Amend#3—100404.doc <br />
