Zook presided as Mr. Russell stepPed down as Chairmnn becausa of a conflict <br /> af lnterest. <br /> Under old businesa, a hearinq was held on the upplicntion of Fdwin Howard, <br /> 510 Alverson Blvd, Evaratt, Washington 98201, for a rehearing on a previous <br /> application that was given to the City Attorncy for a determination as to <br /> whether or not a retaining wall should b�: included in the ovarall measurement <br /> of an existing fence height. The findinq of fuct is that the measuring point <br /> should be from thc top of the retaining wall. <br /> it is now the Soard of luljustment's decision to rule on Section 19.42.020 of <br /> the Everett Municipal Code, Pencee, Paragraph B, as to whether or not thay <br /> will allow a newly constructed six (6) foot fence to remain less than (10) <br /> feet from 7he principal building on the adjoining loc to tho South rather <br /> than tha Code requirement of forty-two (42) inches in height when the fence <br /> ie cloeer than ten (10) feet from t,he principal building on any n3joining lot. <br /> Legal Descrlptions Lots 7, 8, 9 and 10, Slock 108, Plat of <br /> Grandview Add. except the NE ten (10) feet <br /> of said Lot 7. <br /> Addrese: 5:0 Alvcrson Alvd. <br /> Zoninq: R-1 Sinqle Family Low Density Residence <br /> Mr. Willoughby, an at:orney, represented Mr. Noward an: made the following <br /> atatements: <br /> 1. Mr. Howard did get a permit to construct the six fE) foot fence. <br /> 2. The four reasons for granting a variance have becn met. <br /> • 3. Thc Howard's privacy had been Lost Prior to th� construction of <br /> the fence because of aeveral planted and existing trees that <br /> were cut down or died. � <br /> 4. There will be some restriction of room on Mr. Buck's side of the <br /> fence whether tfie fence is 42" or 72" in height. <br />
