Box 564 <br /> Mukilteo, WA 98275 <br /> hereinafter referred to as "Applicant." <br /> For a vnriance from Section 8, Front Yards, to allow construc- <br /> tion of a sinqle family structure on ench of the following <br /> three parcels with a front setback less then the twanty feet <br /> required by code. This same variance was granted by the Board <br /> of l�djustment on June 8, 1988s however, buildinq permits were <br /> not obtained within one year of that date and so the variance <br /> expired. <br /> On the property commonly known as: Parcels 1 and 3 of BI.�► <br /> IB708115004 and Lots 37,78,39 end 40 of Hewitt Heights Addi- <br /> tion, all on the south side of Angle Lane. <br /> The eoerd o! Adjustment, followinq a public hearing on seid <br /> epplication held on Mny 7, 1990, and further havinq reviewad <br /> all testimony, mekes the followinq Findings, Conclusions and <br /> order: <br /> Critarion No. 1• <br /> Thet the veriance is necessary because of exceptional or ex- <br /> traordinary circumstances reqardinq the size, shepe, <br /> topography, or location of the subject property; or the loca- <br /> tion of a pre-existinq improvement on the subject property thnt <br /> conformed to the zoninq code in effect when the improvement was <br /> constructed. <br /> s, g�;, The subject property consists of three seperete <br /> percels with extreme topographic changea. Each of the <br /> three lots hae a level area thnt varies from zero to twen- <br /> ty-nine feet south of the edqe of Angle Lane riqht of way. <br /> The remninder of the lots drop off rapidly to the bottom <br /> of a steep ravine. <br /> The Applicant is proposing to utilize the level aree on <br /> the front of each lot to provide bearinga for footinqs, <br /> qarage slabs, driveways, and provide for off-street perk- <br /> inq Por two cars. Hecauae of the extreme slope of the <br /> lots, it will be necessary to construct the homes on pil- <br /> ing foundations. <br /> l�,nqle Lane has a0 feet of right of way and the 30 foot <br /> street improvement utilizes only the northern portion of <br /> the right of ay, so there is 10 feet of unimproved rlght <br /> of way abutting the subject lots that will provide a set- <br /> back from the street if the variances are granted. <br /> b. Concl�sion: There are unusual circumstances applyinq to <br /> the subject lot because of the topography and the fact <br /> that there is unused right of way on Anqle Lane. <br />
