There is an approximately 50 foot by 50 foot <br /> buildable aren located in the southeast corner of the lot <br /> with the remeinder of the lot fallinq off rapidly to form <br /> a steep ravine. The applicant is propoeing to have a six i <br /> foot front setback instead of the twenty feet required by � <br /> code. The etreet in front of the property dead ends ap- <br /> �roximately 35 feet west of the eaat corner of the eubject <br /> property. The street has 60 feet of right of way with ap- <br /> proximately twenty feet of pavinq which leavas fourteen <br /> feet of unused right of way. If the variance is granted, <br /> there would be twenty feet from the front of the proposed <br /> structure to the edge of the paving. <br /> b, r.+n�� +ai�.+: There are unusual circumstances applying to <br /> the subject lot because of the topoqraphy and the fact <br /> that there is unused right of way on 39th Street. <br /> criterion No. z: <br /> That the variance will not be materially detrimental to the <br /> property in the area of the subject property or to the City as <br /> a whole. <br /> g, Finri�na� Moving the house forward on the lot would not <br /> block anyone's view and would not create a traffic hazard. <br /> Because of the unused right of way there would still be <br />
