2 <br /> Ordinance No. <br /> An Ordinance relating to Restrictions on Precursor Drugs, <br /> Amending Section 1 of Ordinance No. 2541-01 (EMC 10.39.010)and Section 3 of <br /> Ordinance No. 2541-01 (EMC 10.39.030). <br /> Whereas the 2004 State Legislature has found that quantities of ephedrine, <br /> pseudoephedrine, and phenylpropanolamine continue to be sold at the wholesale and <br /> retail levels far in excess of legitimate consumer needs; and <br /> Whereas the 2004 State Legislature has found that the excess quantities being sold are <br /> most likely used in the criminal manufacture of methamphetamine, and that it is therefore <br /> necessary to further regulate the sales of these drugs in order to reduce the threat that <br /> methamphetamine presents to the people of the state; and <br /> Whereas based on its findings the 2004 State Legislature revised state law so that it is <br /> now unlawful for any person to sell or distribute ephedrine products unless the person is <br /> licensed or registered by the Department of Health under the statute concerning <br /> pharmacists or is a practitioner as defined in statute; and <br /> Whereas the 2004 State Legislature also revised state law so that practitioners authorized <br /> to prescribe drugs may sell,transfer or otherwise furnish ephedrine products only as long <br /> as a single transaction does not exceed the three=package,three-gram limitation that <br /> currently exists for other vendors; and <br /> Whereas the Board of Pharmacy may exempt specific ephedrine products from the sales <br /> restriction,upon application of the manufacturer,if the product meets the federal <br /> definition of an ordinary over-the-counter pseudoephedrine product, or the net weight of <br /> the pseudoephedrine base is equal to or less than three grams, even though the package's <br /> total weight exceeds three grams, and the board determines that the value of the product <br /> to the people of Washington outweighs the danger, and the product, as packaged,has not <br /> been used in the illegal manufacture of methamphetamine; and <br /> Whereas the State law amendments became effective July 1,2004;.and <br /> Whereas the Everett City Council deems it appropriate for the City Criminal Code to be <br /> consistent with state law in this area; <br /> NOW,THEREFORE,THE CITY OF'EVERETT DOES ORDAIN: <br /> Section 1: Section 1 of Ordinance No. 2541-01 (EMC 10.39.010), which reads as <br /> follows: <br /> 4 <br />
