Tl�e City of Everett denied the certification aad Guadalupe filed an appeal. A hearing on the appeal xae held before the Nearing Ezaminer of the City of Eve;ett on May 31, 1990, and on July 19, 1990. A decision vae made by the Hearing Examiaer on Auguet 3, 1990. A motion for reconsideration wae filed by Guadalupe's attorney, Franklin C. Butler, on Auguet 14, 1990. Because of a malfunctioning tape recording syetem, no tape recording �rae made of the July 19, 1990, proceedlag. Ae a reeult, the record crae ineufficient and eha hearing had to be re-held. Accordiagly, the decision af the Nearing Ezaminer of the City of E4erett on Auguat 3, 1990, wae aithdrawn aad the hearing wae re-held on January 17, 1991, before the Nearing Ezaminer Pro Tem of Che CSty of L�erett.
