A, Forest Park Addition <br /> commonly known as: 4611 Basswood <br /> The Board of Adjustment, following a public hearing on said <br /> application held on November 13 , 1989 and further having re- <br /> viewed all testimony, mrikes the following Findi.ngs, Con- <br /> clusions and Order: <br /> RrNDTN - D ONG �SZONS: <br /> Criterion No. i • <br /> i <br /> That there have been exceptional or extraordinary circum- <br /> stances or conditions applying to the subject property or as <br /> tu the inten3ed use thereof that do not apply generally to <br /> other properties in the same vicinity or zone. <br /> a. Findina: The applicant is proposing to construct a single <br /> family structure on a 70 by 150 foot lot. The structure <br /> will have an attached three car garage and the applicant <br /> has plann�d a thirty foot wide driveway in order to provide <br /> access to the three car garage. . Zoning regulations limit <br /> driveway width to 20 feet in tha front setback area. <br /> If the Applicant could set the house further back on the <br /> lot so the thirty feet of width would be beyond the twenty <br /> foot setback line he would not need a vaz•iance; however, <br /> the topography of the lot drops off so that it is not pos- <br /> sible to set the house back more than the twenty feet re- <br /> quired by code. <br /> If the driveway was only twenty feet wide at the property <br /> line and was tapered to a thirty foot width at the entrance <br /> to the garage, it would be difficult to back out of the <br /> two sides of the garaqe, and if a vehicle was parked in the <br /> driveway it would block the side garages. <br /> b. Conclusion: There are unusual and extraordinary circum- <br /> stances applyinq to this property because of the topography <br /> of the lot. <br /> Crite,�ion No. 2• <br /> That such variance is necessary for the preservation and en- <br /> joyment of a substantial property right of the appellant pos- <br /> seessed by the owners of other properties in the same vicinity <br /> or zone. <br />
