J ,
NOV 2 0 1989
...................................................................... BOARD OF AWiJST!lENT
CITY OF EVERETT FINDZNGS, CONCLUSIONS AND ORDER VARZANCE NO. 23-89
PuWfc Works Dept.
Based upon the written request for a variance from the City's
zcninq code by:
James L.Jacobs
156 N. 137th
Seattle, WA 98137
tiereinafter referred to as "Applicant, " for a variance from
E.M.C. 19.14 .040 (U) , Driveway width in the required front
yard, to allow a driveway that will be thirty feet wide in-
stead of the 20 feet allowed by code t serve a three-car ga-
rage.
on the followinq described property:
Lot 17, piv. A, Forest Park Addition
commonly known as: 4611 Basswood
The Board of Adjustment, following a public hearing on said
application held on November 13 , 1989 and further having re-
viewed all testimony, mrikes the following Findi.ngs, Con-
clusions and Order:
RrNDTN - D ONG SZONS:
Criterion No. i •
i
That there have been exceptional or extraordinary circum-
stances or conditions applying to the subject property or as
tu the inten3ed use thereof that do not apply generally to
other properties in the same vicinity or zone.
a. Findina: The applicant is proposing to construct a single
family structure on a 70 by 150 foot lot. The structure
will have an attached three car garage and the applicant
has plannd a thirty foot wide driveway in order to provide
access to the three car garage. . Zoning regulations limit
driveway width to 20 feet in tha front setback area.
If the Applicant could set the house further back on the
lot so the thirty feet of width would be beyond the twenty
foot setback line he would not need a vaz•iance; however,
the topography of the lot drops off so that it is not pos-
sible to set the house back more than the twenty feet re-
quired by code.
If the driveway was only twenty feet wide at the property
line and was tapered to a thirty foot width at the entrance
to the garage, it would be difficult to back out of the
two sides of the garaqe, and if a vehicle was parked in the
driveway it would block the side garages.
b. Conclusion: There are unusual and extraordinary circum-
stances applyinq to this property because of the topography
of the lot.
Crite,ion No. 2•
That such variance is necessary for the preservation and en-
joyment of a substantial property right of the appellant pos-
seessed by the owners of other properties in the same vicinity
or zone.
