Resolution shall be presented to the City Council for their <br />consideratior and approval. If the requiremente specified hereir� <br />are not completed vithin one year of the date of the adoption of <br />this Resolution by the City Council, this Resolution shall become <br />vold and all entitlements to the uses permitted herein shall be <br />for.feited, and any use incor.sistent with the R-1 zoning of the <br />property ehall be deemed a violation of the zoning code and be <br />subject to the violation, enforcement and penalty provisions <br />thereof. <br />b. Conetruction of a New Cotnmercial Structure. In accordance <br />with City regulations, the applicant may remove the existing <br />structure from the property Por the purpose of constructing a new <br />building to be ueed consistent with the terms of this Resolution. <br />If the existing structure ie removed from the premises and a new <br />structure is built for commercial purposee, all improvements <br />required by this Resolution and other City regulations shall be <br />completed within one year of the date of issuance oi building <br />permits. Upon completion of the parking lot and landscaping <br />improvements in accordance with the terme specified hereln, a <br />rezone ordinance consistent with this Resolution shall be <br />presented to the City Council for their consideration and <br />approval. If all required permita are not obtained and the <br />construction of a new building is not commenced within two years <br />of the date of adoption of this Resolution by the City Council, <br />thie Resolution ehall become void and all entitlements to the <br />uses per�oitted herein shall� be Porfeited, and any uae <br />�� inconsistent with the R-1 zoning oP the property shall be deemed <br />a violation of the zoning code and be subject to the violation, <br />enPotcement and penalty provisione thereof. � <br />10. Use of Property Inconsietent with this Resolution. If any use of <br />the subject property occurs which is inconsistent with the terms <br />of this Resolution, eithor before, durinq, or after construction <br />end installation of all im�rovements required by this Resolution, <br />thie Resolution shell become void and all entitlements to the <br />uses permitted herein shall be forteited, and any use <br />inconsistent with the R-1 zr,ning of the property shall be deemed <br />a violation of the zoning code and be subject to the violation, <br />enPorcement, and penalty provisions thereof. <br />11. A copy of this Resolution ehall be recorded with the Snohomish <br />County Auditor's Office. All conditions, limitations and terms <br />specified herein shall be bindinq upon the property and all <br />future owners, heirs and essiqns with any interest in the <br />property described herein. <br />
