On DecemUer 22, 1970, Mr. James Davidson filed an appeaL beiore the City of �verett Board / of Adjustment of the City Building Inspector's determination to grant a building permit for the ham radio antenna tower.' On January 4, 1�J71, at a hearing Uefore the City of �verett Board of Adjustment the Bosrd of Adjustment made the following determinations: 1. The property is in an R-2 Zone where the height of a building is restricted to 35 ft. 2. That Section 15. 04. 030 :B' (22) of the City of �verett Zoning Code does not provide an exception for ham radio antennas and tliat tlie terms "chimneys and steeples" in aesthetic 15. 04. 030 B(22) are architectural appendages and antennas are not. Thus, ihe code does not provide any exc��ptions to height ]imitatic,r_s except as to such things as are generically similar to chimneys and steeples, which in the Board's interpretation, ham radio antennas are not. Since the City of �verett Board of Adji:stment has determined that ihe City Builrling Inspcctor's interpretation of the z oning code regarding issuance of Permit No. 12202 is contrary to the tercns of tlie zoning code , and hence illegal, and since Section ll5. 04. 360 of the City of �verett Zoning Code grants the Board of Adjustrr<ent po�ver to reverse any interpretation, order or determination of the City of �verett Building Inspector, I am required to advise you tliat Permit No. 12202 is hereby r�voked and that aince the Perinit has been determined illegally issued� it is void,without legal effect,and has never conferred any legal rights upon the permittee.
