BOARD OF ADJUSTt�NT <br /> FIHDINGS� C0:7�LUSIONS AND ORDER <br /> (March 72, 7985) <br /> V-/1-85 <br /> Based upon the written request for a variance from the City's zoning <br /> code� specifically 78.44.210� made by Harry Platis at 5825 Broadxay, <br /> hereinafter referred to as "Applicant," the Board of Ad3ustment, folloxing a <br /> public hearing on said application held on March 4, 1985, and further having� <br /> reviewed all testimony� nakes the following Findings, Conclusions� and Order: <br /> FINDINGS AND CONCLUSIONS: <br /> 1. There are exceptional or extraordinary circumstances or conditions <br /> applying to the sub3ect property xhich do not apply generally to other, <br /> propertiea in the same vicinity or zone. <br /> a. Findin : The applicant oxns a parcel of property xhlch is <br /> located at 58z5 Hroadway. The applicant's property consists of a <br /> 75' x 431' lot Which is vacant. The applicant is proposing a two <br /> (2) lot Short Subdivision. <br /> b. Conclusion: The applieant's property does have adequate area <br /> for trro lots. <br /> 2. The authorization of the variance xill not be detrimental to the publicl: �� <br /> Welfare or in3urious to the property in the same vicinity or zone. ' <br /> a. Findin : The applicant is proposing one access point onto <br /> Broadcray in which all lots would �h-re a common drive. The <br /> common drive would have leas inpervious surface and xou14 not <br /> require mafntenance by the City. The common drive will reduce <br /> the potential aceess conflict points on Hroadway to one. <br /> b. Conclusion: Reducing conflict point on an arterial is in the <br /> public welfare. <br /> 3. There are no reasonable alternatives whieh Nould allow for acceptable <br /> design of the short subdivision in aceordance Wi;h existing standards. <br /> a. Finding: C1ty stree; standards would require a 40' right-of- <br /> way, 24' pavement. <br /> b. Conclusion: Easement aecess is the most acceptable design to , <br /> the City. <br /> 4. The applicant�s request for a short subdivision has been procesaed by <br /> the City xhich confirms that the final approval cannot be granted <br /> without an authorized variation from the Board. <br /> a. Finding: The applieant has filed a short subdivision Nith the <br /> City. <br /> b.
