It is further recommended <br />that if it is determined that his past actions are not sufficient to reject the bid, that the <br />City take extraordinary precautions. For example, the Performance Bond and Payment <br />Bond provisions of the Street Imprcvement Contract should be CASH BONDSI <br />Ben Holt is the builder, owner and operator of People's Storage located at 7909 South <br />Broadway (the large yellow warehouses just north of the Everett Mall Way, I-5 off ramp). <br />This site is being operated without an occupancy permit. The occupancy permit has been <br />withheld because the site is not in compliance with Ordinance 555 and until recently, tt,e <br />structure was without adequate fire protection as required by the Fire Code. It has been ,i <br />two and a half year struggle to gain from Ben Holt, what every other developer in Everett <br />performs as a routine matter. <br />Numerous hours were spent in 1979 reaching a verbal agreement by Mr. Holt in November <br />to provide the necessary fire protection and an L.I.D. Covenant. Currently, even after <br />hours of additional meetings, letters and explanations, Mr. Holt still has not fulfilled his <br />verbal agreement to comply with City Ordinances and Washington State SEPA regulations. <br />It does not appear to be in the best interest of the City or the participants in the Everett <br />Mall Way L.I.D., to award the contract 1:0 Ben Holt. There may be some special interest <br />on Ben Holt's part that could result in a lesser prpduct, or inappropriate feelings toward; <br />property owners on Everett Mall Way that elect..to comply with City Oreinam es . And, <br />finally, it seems unfair to flaunt negative_ behavior in the face of property owners along <br />Everett Mall that chose to be responsible developers in Everett. <br />CHRONOLOGY OF 7909 50.
