G,.� _ T <br />0���� LIMITED POpER OF ATTORNEY �� <br />WHEREAS, KUMARS MESHGIN, VAGHAR VAHDAT, KHOSROW MESHGIN <br />and KHOSROW AZORDEGAN, each a married man, as his separate property, <br />("owners'9 are the owners and developers of certain real property situated In the <br />City of Everett, Snohomish County, Washington, legally descrfbed In Exhibit A <br />attached hereto and incorporated herefn by this reference, which property is the <br />site of a four buliding, 42 unit condominium development known as New Era (the <br />"project'9; and <br />WHEREAS, the City of Everett, a municipai corporation under the laws of <br />the State of Washingtan ("City"), has required, as a condition to Iss�ance of building <br />permits for the project and as part of the conditlons set forth In the Final <br />Declaratlon oi Non-Significance dated October 2, 1979, which conditions concern <br />mitlgation of the environmental Impact of the project, that the owners execute a <br />power of attorney concernfng formation of local Improvement districts for street <br />purposesin the vlcinity oi the project. <br />NOW, THEREFORE, fo� and in consideration that the City of Everett issue <br />butlding perrnits to the owners for construction of the project and in consideratlon <br />of owners' desire to comply with the conditions of the Final Declaration of Non- <br />Signiflcance lssued in connection with the project, owners have made, constituted <br />and appointed, and by these presents do make, constitute and appoint the City as <br />true and lawful attorney for them and in their name, place and stead, and as an <br />Irrevocable proxy to cast a vote for approval, by petition or otherwise for any local <br />improvement district hereatter tormad by the City, its successor or other property <br />owners in the benefit area encompassing <br />This power of attorney shall be a conveyance of an irrevocable interest in <br />and the owners do by these presents convey to the City such limited interest in the <br />real property described in E•xhibit A. <br />This power o[ attorney shall be a �ovenant to run witli and touch and <br />concern the fee title to the real property described in Exhibit A In perpetuity; <br />provideds the City of Everett shall deliver a signed release ot this power ot <br />attorney after installation of the strcet impravements in the benefit area <br />hereinabove described shall have been completed. <br />
