On Septembec 10 , 1962 , application was made by Eric England for "permit to hang sign at northeast corner ef California and Broadway" , which sign was approved by the City of Everett on Sep�ember 14, 1962. The Permit is attached hereto as Exhibi . 1. Please note the applica- tion contains the following typewritten statement: " . and further agrees to remove same upon notice from the City and to [eplace all public property damaged thereby . " A photocopy oE the sign is attached as Exhibit 2 and a photocopy of the entire block is attached hereto as Exhibit 3. 2. Subsequently, Pizza Hut, Inc. contr.acted for the con- struction oE a b�iilding at 2727 Broadway. The plan � submitted and app�oved by the City of Everett required the sign to be removed by the general contractor . For ; s�me reason, the general contractor did not remove the ' sign. A cnpy of a portion of the plans is attached � hereto as Exhibit 4 and 5. � �
