The owner of thP sign refuses to remove the sign. <br /> 5. The sign interferes with visability to the property <br /> owned by Pizza Hut, Inc. <br /> 6. The sign presents a potential danger to motorists and <br /> residents of the City of Everett. <br /> 7. The sign is contrary to City of Everett ordinances. <br /> Ordinance 13 . 16 . 100 , Public property: "City atreet <br /> clght-of-way may not be used Eor private commercial <br /> purposes. " <br /> Ordinance 13. 16.060D, Location of �tructures: "No sign <br /> structuce, support, pole, atand, brace oc appurtenance <br /> of any sign shall be placed on public property. " <br /> 8. The City of Everett Public Works Department believes the <br /> eign should be removed and the City Attorney of Everett <br /> complies therewith. <br /> 9. As a condition to the aign removal , Pizza Hut , Inc. <br /> agrees to save harmless the City of Everett Erom all <br /> claims for damages, costs, expenses or causes uf action <br /> that may arise because of the cemoval of the sign and <br /> further agrees to remove the aign and replace the public <br /> property damaged therPby at its sole cost and expense, <br /> reserving unto itself the right to make claim against <br /> Eric England, who has obligated himself to remove said <br /> sign upon demand of the City of Everett. <br /> In conclusion, Pizza Hut, Inc. , by and through the under- <br /> ' signed, req�ests that the City of Everett, by and through its <br /> � i <br /> � <br /> � <br />
