The City would li4e to facilitate the construction of new <br /> housing and to recJuce the eifects ut inilation on the final costs ot housing to the <br /> residents oi Everett. <br /> , 2. Developer recognizes and acknowledges the need for improvement of <br /> Casino Road because of the facts set forth herein and Exhibit N as incorporated <br /> herein. Developer shal! fully comply with the requirements for obtaining a building <br /> permit for its propos^d d^velopment as set forth in Ezhibit A, as well as other City <br /> ordinances. <br /> 3. Upon fultillment by Urveloper of the rcquircments currently set forth <br /> in Lxhibit A, and compliance with all other applicable ordinanczs and regulations, <br /> tlie City will issu� a building permit to Developer for construction of its proposed <br /> development i� accordance with the plans and specifications on file for tliat project, <br /> and approved by the City of Evcrett f3uilding Department. <br /> 4. Dcaeloper will not be s��gled oui by City 'o perform any requirement, <br /> �vhich• do^s not apply equally to other deeelopments proposed or to be proposed <br /> alorig Ca;ino Road which are similarly situated. • <br /> 5. Failure to comply witli the terms of tliis Agrcement on the part of <br /> Ueveloper shall result in immediatc suspension of all permits rclated to the <br /> ' cons.ruction of the subject development; all other remedies of the City induding <br /> thosc under thc Uniform Duilding Code or other ordinances of the City are <br /> cxpressly prescrvcd as additional to any remedies hercin. <br /> 6.
