� � . <br /> EASEMENT <br /> This easement is granted subject to and conditioned upon the following urtns, conditions and <br /> covenants: <br /> 1. Grantor shall at all times conduct its activities and all othe: activides conducted on <br /> Grantols property so as not to interfere with, obstruct or endanger the usefulness of any <br /> improvements, or other facilities, now or hereafter maintained upon the easement, or in any way <br /> interfere with,obshuct or endanger the City's use of the easement. <br /> 2. Prior to any construcdon, work or any other ectivity by Grantor within the easement, <br /> notification and plans for the snme shall be submitted in writing to the City by Grantor and no <br /> such construcdon, work or activity by Grantor shall be commenced without Ciry's prior written <br /> agreement that the Grantor's proposed conswction, work or nctivity will not interfere with the <br /> City's easement granted herein; PROVIDED, HOWEVER, eny chnnges or rcvisions in the plans <br /> shail also be subject to Ciry's prior agreement. The City's review of the Grantor's plans under <br /> this easement shall not be deemed to impose any duty or obligation on the City to determine the <br /> adequacy or sufficiency of Grantor's plans and design:� nor whether Grantot's construction, work <br /> or activity is in conformance with other applicable plans, codes and regulations. FurLher, <br /> agrcement by the City to such construction, work or activity shall not in any manner be <br /> considered as imposing nny obligation, dury or linbility upon the City as to the safery or <br /> propriety of such construction,work or activity. <br /> 3. Grantor hereby nuthorizes City to cut, trim and remove a�iy and nll brush, trees, ather <br /> vegetation or debris upon the eazement and the right of access for such purposes. Grantor also <br /> authorizes the City to cut, trim nnd remove any and �ill brush, trees, other vegetation and debris <br /> on Grantor's property which, in the Ciry's reasonable judgment, constitutes a ha�rd to the <br /> easement and the right of nccess for such purposes. <br /> z <br /> gsoal9ooi7 <br />
