EASEMENT <br /> 4. The Grantor agrees thnt dde to all brush, trees, other vegetation or debris trimmed, cut <br /> end removed from the easement pursuant to this Agreemeat, and also all bnuh, trees, other <br /> vegetation or debris trimmed,cut end removed from Grantor's lend pursuant to this Agreement is <br /> vested in the City, and that the consideradon paid for conveying said easement end rights hercin <br /> described is accepted es fiill compensation for all demeges incidental to the exercise of any of <br /> said rights. <br /> 5. In the event Grantor places any improvements on or in the easement or conswcts <br /> anything within the easement without first having abteined the written approval of the City <br /> Enginecr, the Grantor shnll cease all such activity and remove any and all improvements placed <br /> therein without the written agrcement of the City Engineer. in the event Grantor fails to obtain <br /> prior approval, Grantor hereby authorius the City to remove any and nll improvements placed or <br /> constructed therein and hold the City, its officers, emplayees and agenu hermless from damage <br /> caused to said improvements from removal thereof. Grantor further agrees to pay the City for <br /> any and nll costs incumd by the City in removing the improvements. This right is in addition to <br /> uny other right the City may have ut law or in equity. <br /> 6. Grnntor does rclease, indemnify and promise to defend and save harmless the City, its <br /> officers, employees and n�ents from und against nny nnd all liability, loss, damage, expensc, <br /> actions and claims, in�luding costs and rcasonnble ettamey's fees incurred by the City, its <br /> officers, cmployees and agents in defense thenof, asserdng or arising directly or indiroctly on <br /> account of or out of Grantor's use or activity within the above-described easement.
