The easement is over and ecrosa a tract of land situated in the Count,y of <br /> Snohomish, State of Washington, and the e�sement ia described as follovs: <br /> Sae Exhibit "A" attached hereto and incorporated herein by reference. <br /> Thie easement is granted subject to and condLtioned �pon the following terme, <br /> conditions and covenants: <br /> 1. Crantor shall at all times conduct its activities and all othez <br /> activities conducted on Crantor's property so as not to interfere with, <br /> obatruct or endanger the usefulness of any improvements, or other facilities, <br /> now or hereafter riainteined upon the easement, ar in any way interfare with, <br /> obetruct or endanger the City's use of tha eaeement. <br /> 2. Prior to any constructlan, work or any other activity by Czantor on <br /> the easement, a notification and plans for the sama shall be eubmitted in <br /> writing to the City by Contractor and no such conatruction, work or activity <br /> by Grantor ahall ba commencad without City's prior written agreement that the <br /> Grantor's proposed construction, work or activity will not intorfere with the <br /> City's eesement granted herein; PROVIDED, HOWEVER, any chenges or revisions in <br /> tha plans shall also be aub�ect to City's prior agreement. The City's reviaw <br /> of the Cranl•or's plans under this easement shall not be deemed to imposa any ' <br /> duty or obligation on the City to detarmina the adequecy or sufficiency of <br /> Crantor's plens end designe nor whethnr Crantor's construction, vork or <br /> activity is in conformanca vith othez applicable plena, co���s and <br /> regulatlons.
