Either a si>lid, siqht obscuring fence a minimum of 42 inches high <br /> or a landscupe strip a minimum of 5 feet wide must be provid�d <br /> along the entire west property lino to provide screening of car <br /> lights and sepc�.ration from the adjacent property. If landscaping <br /> is provided, plantings must include sufficient everqreen trees or <br /> shrubs a minimum of � �eet high to prcvide screening. Tall landscape buffering must be placed along the 18th hole of <br /> the golf course along the southern property brimdary to ensure <br /> that erranc golf balls do not cause damaqe to he structure or <br /> any lndividual living in the apartment complex. A landscapinq <br /> pl.an for this project must be reviewed and approved by the <br /> Planning Department prior to the iseuance of any Building permits <br /> for this proposal. The landscapinq plan should provide <br /> information on qrade changes between the site and adjacent <br /> properties. (SEPA Land and Shoreline Use Policies) <br /> 7. The Applicant shall provide a statement in all rental lease <br /> aqreements for the apartment units surrounding the southern <br /> border to include the following: <br /> nThese apartment units are adjacent to and abut Walter <br /> E. Hall Golf Course. The proximity to the golf course <br /> creates the possibility of personal injury or property <br /> damage by an errant golf ball . �s a material. condition <br /> of this rental agreement, and in oonsideration of the <br /> aesthetic and other benefits 4f b�ing adjacent to the <br /> golf course, i/we on behelf of ourselves, qaests, and <br /> invitea, agree to save and hold the owner, as well as <br /> the City of Everett, .harmless from any and all personal <br /> injury, property damaqe, or other causes of action which <br /> arise or miqht arise from errant golf balls emanatinq <br /> from the Walter E. Hell Golf Course. I/we on behalf of <br /> ourselves, guests, and inviten , do further hereby assume <br /> all risk attended with occupying this area or other <br /> common areas of the park, includinq the risk of personal <br /> injury or property damage caused by errant golf ball <br /> shots. Further, I/we agree to advise the agency and <br /> underwriter of any casualty and liability insurance <br /> which we obtain for our property of the proximity of our <br /> livinq area to the Walter E. Hall Golf Course, as well <br /> as the contents of this rental aqreement. " <br /> 2 <br />
