They propose to meet their parking requirement by leasing 35 spaces <br />from Temple Baptist Church. The church curently does not meet parking <br />requirements since there are 500 seats in the chapel which would <br />require 100 off-street parking spaces; however, the congregation is <br />only 150 which would require only 30 off-street parking spaces (Code <br />requirement is one parking space for each five seats in the chapel or <br />nave). The church is on a 3 1/2 acre site so there is plenty of room <br />to provide additional parking if the need arises. <br />In addition, the peak occupancy time for the church is at a time of low <br />occupancy for the clinic and vice versa. The clinic will lease the 35 <br />stalls from 6:00 AM to 6:00 PM Monday through Friday and since the <br />church holds two services on Sunday and only one on a weekday, <br />Wednesday from 7:00 to 10:00 PM, there will be no conflict between the <br />two uses. <br />Conclusion: There are exceptional circumstances applying to the site <br />in regard to the need for off-street parking. <br />2. That such variance is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed by the owners of <br />other properties in the same vicinity or +one. <br />Finding: Parking variances have been granted in other cases where the <br />applicant has not needed the amount of off-street parking required by <br />Code. <br />Conclusion: The variance would allow a property right possessed by <br />owners of other properties with similar circumstances. <br />3. That the authorization of such vari?nee will not be materially <br />detrimental to the public welfare or _ajurious to property in the <br />vicinity or zone in which the property i.c located. <br />Finding: If the variance is granted, the church will still have <br />adequate parking and by leasing their excess spaces to the clinic w7.11 <br />provide needed parking and relieve a parking problem in the area. <br />There were no adverse comments from other City Departments on the <br />requested variance. <br />Conclusion: This variance would not be materially detrlmented to tha <br />plublic welfare or injurious to other properties in the vicinity and <br />zone. <br />4. That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />Finding: The 1967 Comprehensive Plan designates the area a Multiple <br />Family Residential and churches are a permitted use in the R-3 zone. <br />Conclusion: Granting of this variance will not adversely affect the <br />Comprehensive Plan. <br />(APPROVE the variance as requested by applicant with the following condition. <br />1.
