Board oiAdjustment <br />September C. 1986 <br />Page 8 <br />He further raised the question of whether Group Health, the Church, or the <br />City would be liable in the event of an accident. <br />In response to a question from Mr. Hoagland, Mr. Giuntoli stated that the <br />request for more 1,prking space resulted from Group Health's application for a <br />building permit, in which it was discovered that they no longer had adequate <br />parking space and would have to provide it in order to obtain their building <br />permit. In response to a question from Mr. Hoagland, Mr. Giuntoli stated that <br />Group Health had offered last May to build a crosswalk, signage or whatever the <br />Public Works Department wanted, and the recommendation which came back from the <br />City Engineering Department was against that, so he is uncertain what else they <br />could do there in order to address public safety and still obtain their building <br />permit in a timely manner. Additionally, he pointed out that the parking across <br />the street, i.e. at Temple Baptist Church, will be used exclusively by employees, <br />and Group Health believes they will "learn to negotiate the street". His <br />assumption is that they will go to the lighted intersection. Thirty-five staff <br />would be utilizing the leased parking spaces. In response to a question from <br />Everett Miller regarding future availability of parking, Mr. Giuntoli stated that <br />Group Health would have to find space from an adjoining property owner within <br />300 feet of Group Health. In response to a comment from Marie Sullivan that <br />some patients would inevitably end up using parking spaces in the leased lot <br />across the street at the Church, Mr. Giuntoli answered that that is not Group <br />Health's intention, and furthermore, some of the staff are currently parking <br />in Fred Meyer's lot. He also pointed out that Group Health's leqal department <br />had prepared the lease document which holds the Church blameless in the event <br />of an accident. <br />Chairman Hoagland asked Everett Miller whether he could vote on this case <br />at this point. Mr. Miller answered no and requested a month delay in order to <br />more carefully consider the question of public safety. <br />Motion: Everett Miller formally offered o motion to table this matter for <br />further investigation by the City, especially with reference to the <br />City's liability if someone were injured crossing the street. The <br />motion was seconded by Marie Sullivan. Ross Hoagland commented that <br />he concurs because the Board feels the City has not looked into this <br />as deeply as it could have. Further, he commented that this would <br />give Pastor Stave an opportunity to investigate their tax status. <br />Vote: Unanimous in favor of tabling this matter until the October meeting. <br />The meeting was adjourned at 8:34 p.m <br />I-ML Jeea,�_ <br />Dennis L.
