MMMO <br />OCT 13,,966 <br />BOARD Oc ADJUSTMENT - ............................... <br />FINDINGS, CONCLUSIONS AND ORDER CITY OF EVERETT <br />VARIANCE N0.35-86 Put:jc Works Dept - <br />Based upon the written request for a variance from the City's zoning code by: <br />Temple Baptist Church <br />1 West rasino Rd. <br />Everett, WA 98203 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. 19.40.020 <br />Off -Street Parking to .11ow: <br />The church to lease 35 off-street parking spaces <br />to Group Health, who is located ac-oss Casino Road <br />from the church, thereby reduc..ng the church <br />off-street parking from approximately 77 spaces to <br />45. Code requires 100. <br />on the following described property <br />See Exhibit "A" <br />commonly known as 1 West Casino Road <br />The Board of Adjustment, following a public hearing on said application held <br />on October 611986 and further having reviewed all testimony, makes the <br />following Findings, Conclus!.ons and Order: <br />FINDINGS AND CONCLUSIONS: <br />1. That there have beer. exceptional or extraordinary circumstances or <br />conditions applying to the subject property or as to the intended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />Finding: Group Eealth at 14 East Casino Road, across the street from <br />the church, is eleven spaces short of nesting code requirements for <br />parking and there have been complaints about lank of parking at that <br />site. Group Health first moved to their current site as a tenant <br />occupying a part of the building. As time went on, they occupied an <br />increasing portion of the building and subsequently purchased the <br />building. <br />They propose to meet their parking requirement by leasing 35 spaces <br />from Temple Baptist Church. The church currently does not meet <br />parPtng requirements since there are 500 seats in the chapel which <br />would require 100 off-street parking spaces; however, the <br />congregatlor. '.a only 150 which would require only 30 off-street <br />parking spaces (Code requirement is one parking space fur each five <br />seats in the chapel or nave). The churc., is on a 3 112 acre site so <br />there is plenty of room to provide additional parking i.f the need <br />arises. <br />In addition, the peak occupancy time for the church is at a time of <br />low occupancy for the clinic and vice versa. The clinic will lease <br />the 35 stalls from 6:00 AM to 6:00 PM Monday through Friday and since <br />the church holds two services on Sunday and only one on a weekday, <br />Wednesday from 7:00 to 10:00 PM, there will be no conflict between <br />the two uses. <br />Conclusion: There are exceptional circumstances applying .0 the site <br />in regard to the need for off-street parking. <br />2. That such variance is necessary for the preservation and njoyment of <br />a substantial property right of the appellant possessed 1 the owners <br />of other properties in the same vicinity or zone. <br />Finding: Farking variances have been granted in other cases where <br />the applicant h.s not needed the amount of -'f-street .arking <br />required by Code. <br />
