II. Develop�ent of the Site (Purauant to the Site Plans) �ubsequent to the pe�mit approval, the Mukilteo Sc3�oo1 District sulmitted a lettec from its repreaentatives, Curtmings Associates Ardiitects. In the letter it is atated that based upon a more detailed topographic survey of the subja:t property, it has becane apparent that an existing storm water pipe exterding south fran Casino Road dcea not extend as fac south as shown on an aerial topographic map. This error in the original topographic map cesulted in a conclusion that there would be only one crossing of the stream. However, it has becane apparent that there will be two crossings of the stream in order to adequately oover the exiating storm water pipea. Accordingly, condition �8 of the mitigated DNS is amended to allow the developnent of the site with two crossinga of the stream as approved by the Department of Public Works. In conjunction with the modification of condition AB of the mitigated DNS and condition t3 of the Special Property Use Pe�mit, it is also noted that the stceam channel that extends in the southerly direction will have a mudi deeper depression than as originally proposed. The lower elevation, as shown on the contour line, will result in the stream being a 10' to 19' depresaion. The MukilGeo Sdiool Di.�trict has requested that it be allowed to enclose the creek thcouyh this section 1n a pipe and to partially fill the depression cnd install a grasslined biofiltration swale on the higher surfaces of the pipe stream. 'Ihis req�est is reasonable and is, in fact, desicable in order to cenove the attractive nuisance of the depression. Acwrdingly, condition A8 of the mitigated DNS and condition #3 of the Special Property Use Pecmit are amended to allow the Mukilteo Sdwol District to enclose the creek thcough this specific section in a pipe and to fill the depreasion ard install a grasslined biofiltration swale on the new higher surfaces over the pipe stream. This enclosure of the creek in the pipe should be done purwant to Department of Public Works approval of the dimensions and with the appcoval of the Department of Wildlife and the Department of Ecology. From the docwnents subnitted, it appears that the Department of Wildlife and Department oE Ecology have approved said changes. � I�
