This paragraph does not purport to indemnify the City, its

<br /> arisinq out of bodily injury to persons or damages caused by ,
<br /> � � or resulting from the sole neqligence of the City, its
<br /> officers, employees and agents; provided, that if the claims
<br /> p x or damages are caused by or result from the concurrent
<br /> 9 y y negliqence of (a) the City, its officers, employees,
<br /> r officers, employees or agents, and (b) Applicant, its
<br /> y �� aqents, servants, employees, officers,subcontractore,
<br /> K y� sublicensees, successors or assigns, this indemnity
<br /> O x o provision shall be valid and enforceable to the extent of
<br /> � y H the negligence of Applicant, its agenta, servants,
<br /> � �� employees, officers, subcontractors, sublicensees,
<br /> O �� successors or assigna. (For example, where Applicant is
<br /> 25$ negligent, the indemnification shall extend to 25$ of
<br /> � �g the City's concurrent negligence. )

<br /> � H� In addition, Applicant shall secure Public Liability and
<br /> H y Property damaye insurance coverage in the minimum amount of
<br /> g y $500,000 for death or injury to any one person, and $500,000
<br /> o C w for death or injury to two or more persons in any one
<br /> �� occurrence, and $l00,00o for property damaqe in any one
<br /> y� occurrence with any aggregate property damage coverage of
<br /> H o v� $100,000 for two or more occurrences from an insurance
<br /> company authorized to do business in the State of
<br /> Waehinqton. City shall be an additional named insured on
<br /> said insurance in a form acceptable to the City Attorney.

<br /> � '�� Condition of Premises. It is understood tha Applicant has
<br /> � "` � inspected the Premises and takes them "AS IS��. City is not
<br /> obligated by the permit to make any changes, removals, or
<br /> � ,� repairs of any kind. Applicant represents that it has
<br /> � inapected the Premiaea and that the Premises, at the time
<br /> the permit was entered into, were reasonably free from soil
<br /> and/or gr�undwater contamination or other pollution-induced
<br /> !� � conditions, and the condition of the Fremises appeared to
<br /> � the Applicant to meet all federal, state and local laws,
<br /> ordinances, codes and regulations, designed to prevent or
<br /> � ( ' control the discharge of subetances ir�to the land, air �nd
<br /> _ � water.
<br /> VII.
<br /> —' � Nuieanoe. Applicant shall not permit the existence of any
<br /> nuisance on the Premises; shall keep the same in clean and
<br /> ! � safe condition and free of any explosive, flammable or
<br /> � � combustible material which would increase the risk of fire.
<br /> Applicant shall not handle or atore any dangerous or
<br /> potentially dangerous materials, or any hazardous or toxic
<br /> � ' materials, as defined under state or federal laws; and
<br /> shall not permit the accumulation of junk, noxious weeds,
<br /> debris or other unsightly materials. Applicant shall, at
<br /> its sole expense, keep the Premises and any other
<br /> improvements in good repair.
