As noted, all utility and communication facilities are to be installed <br /> underground or within structures which maximize safety and minimize <br /> visual and noise impacts. The Installation of the monopole underground <br /> would be impractical. The electrical installation for utility service to the <br /> site can be underground. (Exhibit 1) <br /> 20. The Applicant indicated that the 150 foot tall monopole is the lowest <br /> height possible to adequately serve the needs of the community and the <br /> state. (Sullivan testimony) <br /> 21. As part of the prcposal, the Applicant is seeking a variance to exceed <br /> the 28 foot maximum height standard for structures in an R-2 Zone and <br /> a variance from the 1 SO foot setback standards as set forth in EMC <br /> 19.39.040. In order for these variances tu be granted, the criteria of <br /> EMC 19.41.130.0 must be satisfied. <br /> (a) That the variance is necessary because of exceptional or <br /> extr��ordinary circumstances regarding the size, shape, topography, or <br /> location of the subject property; or the location of a pre-existing <br /> improvement on the subject property that conformed to the Zoning Code <br /> in effect when the improvement was constructed. <br /> (b) That the variance will not be materially detrimental to the property <br /> in the area o(the subject property or to the City as a whole. <br /> 6 <br />
