At the public hearing testimony was received with regard to the proposal. <br /> A summary of the testimony is: <br /> A. Jeanne Nalbsch - The witness submitted that she had been a <br /> resident of the area for twenty-th;•ee years. She stated that the property <br /> is not zoned for the proposal because the R-2 zone is residential, and <br /> the proposal is "very commercial". She submitted that the Applicant <br /> should have moved the tower at the same time they moved the office, <br /> and the proposal is not consistent with the residential use. <br /> B. Nick Eckert- The witness testified to be the President of the <br /> Riverside Neighborhood Association. He submitted his opposition to the <br /> Special Property Use Permit and the requested variance. He questioned <br /> the use of the monopole by U.S. West as being "tax free". He submitted <br /> that the City of Everett will receive no benefit and requested that the <br /> monopole be onA mile south of the existing location. <br /> Jurlsdiction: The Hearing Examiner of the City o/Everett has jurisdicti�nal <br /> authorify to hold a hearing and to issue the decision. That authority is set forth <br /> in EMC 2.23.120. 8ased on the above findings, the Hearing Examiner enters <br /> the lollowing conclusions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approval of a Special Property Use Permit for <br /> the placement of a 150 foot tall monopole on property at 3200 - 20th <br /> Street, Everett, Washington. The monopole will replace a 300 foot tall <br /> wooden tower. The monopole will contain a design which wiil support <br /> five whip antennas, one microwave dish and 21 panel antennas. An 11 <br /> foot high whip antenna will be placed on the top of the monopole. In <br /> order Io develop such a monopole, the Applicant must also secure a <br /> variance from rhe 28 foot structural height limitation for R-2 zoned <br /> property. The Applicant is also seeking a variance from the 150 foot <br /> setback standards as set forth in EMC 19.39.040. The site will contain <br /> equipment cabinets and seven foot high fencing around the base of the <br /> monopole. (Finding 1) <br /> 2. In order for a Special Property Use Permit to be granted within the City <br /> of Everett, tho criteria of EMC 19.41.150.0 must be satisfied. With <br /> conditions, these criteria are satisfied.
