BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that the <br /> City of Everett: <br /> A. States its appreciation for the long-term vision in the Plan of working toward the <br /> Chinook and bull trout recovery targets established by the Washington State co- <br /> managers and U.S. Fish and Wildlife Services and for taking actions to avoid future <br /> salmonid listings under the Endangered Species Act. <br /> B. Cooperates with the goal of the Snohomish Basin Salmon Recovery Forum to <br /> protect, restore, and enhance the productivity of all wild salmon stocks in the <br /> Snohomish Basin to a level that will sustain fisheries and non-consumptive salmon- <br /> related cultural values. <br /> C. Recognizes that the ten-year habitat improvement milestones in the Plan is a clear <br /> path to making significant progress towards salmon recovery. <br /> The City of Everett makes commitments to implement Everett's portion of the <br /> Plan, provided the following conditions are met: <br /> 1. If the City of Everett commits to plan implementation, then NOAA Fisheries and <br /> USFWS will each agree to adopt the Plan, as an operative element of their separate ESA <br /> section 4(f) recovery plans for Puget Sound Chinook salmon and Puget Sound bull trout; <br /> and the State of Washington must accept the Plan and basin recovery strategy for the <br /> purposes of allocating funding. <br /> 2. If the City of Everett commits to implementing Everett's portion of the Plan and is <br /> making progress, then NOAA, Fisheries and USFWS: <br /> a. shall not take enforcement actions, direct or otherwise, against the City of Everett <br /> under ESA, and <br /> b. shall support plan actions against legal challenges by third parties. <br /> 3. If the City of Everett commits to implementing Everett's portion of the Plan, then the <br /> federal and state government will reward commitments through: <br /> a. direct funding and other monetary incentives to cover the costs of <br /> implementation, <br /> b. streamlined permitting of projects being implemented primarily for the purpose of <br /> habitat restoration. <br /> 3 <br />
