Letter Rutkowski <br />August 27, 1991 <br />Page 2 <br />If either of the above conditions are not met, the <br />City may, at the discretion of the Planning <br />Director, either withhold issuance of building <br />permits or require a performance bond in the <br />amount of 300 percent of the value of the <br />landscape improvements not installed, in <br />accordance with Section 40 of the Zoning Code. <br />The Planning Director may allow for some limited <br />flexibility in the phasing schedule due to delays <br />caused by poor weather, unfavorable planting <br />times, or ongoing construction activities. Such a <br />determination must be preceded by a written <br />request from Boeing. <br />The phasing plan, dated August 26, 1991, identifies "Area 2" <br />as the area "along the west side of Seaway Boulevard from <br />south of the 40-87 building to the Boeing north property <br />line, and along the north property line from Seaway <br />Boulevard to the 40-95 building." As a point of <br />clarification, the City interprets "Area 2" as being all of <br />that area shown in Figure 17 of the Draft EIS that will be <br />triggered by the issuance of building permits for the 40-87 <br />and 40-88 buildings. This includes landscaping of the <br />perimeter of the site, internal roadways, building <br />perimeter, and interior parking areas. <br />The City understands that Boeing will submit a complete <br />landscaping phasing plan as part of the revised Master <br />Landscape Plan prior to issuance of the first occupancy <br />Permit for buildings covered under the Decision Document. <br />Please note that the Decision Document is currently being <br />reviewed by the City Council on appeal; pursuant to the <br />administrative appeals procedures set forth in <br />VAC 197-11-680 and the City of Everett SEPA Ordinance <br />1348-87, Sections VII.B.5. and VII.C. Should the City <br />Council choose to amand the terms or conditions of the <br />Decision Document, this partial Landscape Plan Phasing <br />Schedule Approval terms and conditions stated or implied in <br />this letter may be modified by the City, accordingly. <br />:WA: <br />
