'IPemr <br /> tsar <br /> EYEt,: <br /> CITY OF EVERETT <br /> PLANNING COMMISSION <br /> RESOLUTION NO. 02-8 <br /> A Resolution Recommending that City Council Approve the revision to the <br /> approved site plan for the Safeway at 41st & Rucker, previously approved under <br /> Rezone No. 98-001, Resolution of Intent to Rezone <br /> WHEREAS, on January 26, 2000 the Everett City Council approved Ordinance 2441-00 <br /> amending the City's Comprehensive Plan to allow construction of an expanded grocery <br /> store by Safeway Stores, Inc. at 41st Street and Rucker Avenue; and <br /> WHEREAS, on January 26, 2000 the Everett City Council also adopted Resolution No. <br /> 4866, a Resolution of Intent to Rezone a portion of the site proposed by Safeway for the <br /> new store; and <br /> WHEREAS, Resolution No. 4866 approved a specific site plan for development of the <br /> overall Safeway property; and <br /> WHEREAS, Resolution No. 4866 directed Safeway to develop the BP Service Station <br /> site to the same standards as the rest of the Safeway property at such time as Safeway <br /> gained control of the BP Station; and <br /> WHEREAS, Safeway Stores, Inc. later proposed redevelopment of a portion of the site <br /> for a gas station and also requested that a portion of the site plan approved under <br /> Resolution 4866 be modified to accommodate the proposed gas station; and <br /> WHEREAS, the City conducted an environmental review of this proposal and issued a <br /> final mitigated determination of non-significance on the project with certain conditions; <br /> and <br /> WHEREAS, the Planning Commission held a Public Hearing on the proposed revision <br /> to the approved site plan on October 1, 2002; and <br /> WHEREAS, the Planning Commission finds: <br /> 1. The proposed modification of the site plan in general integrates the proposed gas <br /> station into the previously approved site plan; and <br />
