OP <br /> o/OZ7Immi4 <br /> EVERETT CITY COUNCIL <br /> RESOLUTION NO. 5605 <br /> A Resolution approving an Amendment to the Comprehensive Plan Map <br /> designation from Single Family (1.1) to Community Business (4.2) <br /> on the two residential Properties at the Southeast Corner <br /> of 19th Avenue SE and 96th Street SE. <br /> the Clark Amendment. <br /> WHEREAS, the City of Everett adopted a new Comprehensive Plan in August, 1994, in <br /> conformance with the Washington State Growth Management Act; and <br /> WHEREAS,the Growth Management Act, codified as Chapter 36.70A, allows for <br /> comprehensive plans to be amended on an annual basis; and <br /> WHEREAS, the City of Everett initiated its 2004 annual comprehensive plan amendment <br /> process in July, 2004, which included consideration of Land Use Map amendments and rezone <br /> applications initiated by property owners; and <br /> WHEREAS, Mr. Clark submitted an application for an amendment to the Land Use Map for <br /> two properties located east of 19th Avenue SE on 96th Street SE, from Single Family(1.1) to <br /> Community Business(4.2), as indicated on the attached map (Exhibit "A"); and <br /> WHEREAS, the Planning Commission held two public hearings on the matter on February 1, <br /> 2005 and continued it to March 1, 2005 at which they continued public testimony, applicant and <br /> staff presentations and considered the various aspects of the proposal;and <br /> WHEREAS, March 1, 2005,the Planning Commission did recommend approval of the <br /> requested Comprehensive Plan amendment and rezone, subject to certain conditions. <br /> WHEREAS, THE CITY COUNCIL FINDS: <br /> 1. The purpose for the requested Comprehensive Plan land use map amendment is to join <br /> the subject area to a larger area under control, or presumed to be under control, of the applicant <br /> such that it can be joined in a larger property and developed as an integrated project; and <br /> 2. The need for the proposed joined project is to allow access to 96th Street and in turn <br /> improved access to 19th Avenue (Exhibit "B"); and <br /> - 1 - <br />
