BENNEtT <br /> Everett, Washington 98206 o;,�no� � <br /> RE: Ferg-n�-Sons, 2101 Colby � <br /> Dear John: <br /> Following up on our conversation of a few weeks ago, I have re- <br /> viewed ihis matter with the following findings: <br /> Reqarding the use of the building, I think that you and I agree <br /> that retail sales were not to be a part of the Ferg-n-Sons opera- <br /> tion. At the time of our original discussions, this firm was op- <br /> erating a retail outlet on North IIroadway which I unders�and has <br /> since closed. While there has been some talk of the firm opening <br /> a retail store at the Everett Piall, there is anparently no def.i- <br /> nite time for this happening. The City' s Uasis for not allowing <br /> retail activity cvas that the prior occupancy of the building was <br /> limited to storage and while a minor concession was made to per- <br /> mit the Plaster molding operation, the Code could not perr�it a <br /> full scale retail use to occupy the building. We must remain firm <br /> in this interpretation. <br /> Secondly, with re9ard to the signing, the re-occupancy of a non- <br /> conforming buil3iny carrie� with it the reauirement Sor not more <br /> than one, non-lighted sign placecl ilat acainst the building. <br /> i have spoken with the sign contractor and with personnel in our <br /> Department. The contractor states that he was told that by way <br /> of a "horse trade" he was permitted to place the three signs on <br /> the buildinq in exchange for removal of the electrical sign orevi- <br /> ously attached to the building . I have been unable to confirm <br /> this with anybody in our Department. <br />
