20. Permits are required from the City of Everett Fire Department <br />for the removal of the underground tanks. <br />21. There are new tank closure requirements in the federal rules for <br />underground storage tanks. These requirements include (1) a <br />site assessment to determine whether contamination has occurred, <br />and (2) filing of a notice of intent to permanently close the <br />tank with the Department of Ecology at least 30 days prior to <br />closure. Information on the closure notice may be obtained by <br />calling 1-800-826-7716.. <br />The Environmental Protection Agency's minimum requirements are <br />that closure of underground storage tanks must be accompanied by <br />sampling for contamination in the: excavation area. The presence <br />of contaminated soils or ground water, or the presence of free <br />product, requires notification of the Department of Ecology <br />within 24 hours. Please call Mr. Joe Hickey of the Northwest <br />Regional Office at (206) 867-7202. He will identify the type of <br />testing that will be required. <br />The Environmental Protection Agency requires the results of an <br />excavation zone assessment be maintained at least three years <br />after completion of permanent closure or change -in-service. The <br />Washington State Department of Ecology recommends that records <br />be kept in the property file indefinitely for any future <br />property transfers. These records should be maintained by <br />successive owners to fulfill liability requirements under the <br />Washington Model Toxics Act, Initiative 97. <br />22. Based upon the lists of permitted uses in the Zoning Code, the <br />City has determined that the land farming of petroleum <br />contaminated soils is most similar to "composting or recycling" <br />activities. These uses are 1'sted as permitted uses in the C-2 <br />(Heavy Commercial - Light Industrial) and M-M (Heavy <br />Manufacturing) zones through a public hearing process before the <br />City's Land Use Hearing Examiner (Review Process IIIB). <br />The City will also allow the land farming of petroleum <br />contaminated soils as an accessory use on the site where the <br />contamination occurred. <br />23. All tanks removed from the site must be disposed of in an <br />approved location. <br />24. The proposal must also comply with all other City Code and <br />ordinance requirements not specifically set forth herein. <br />19 <br />
