� <br /> Board of Adjust�oent Meeting 1 <br /> ' January 11, 1982 <br /> Page -3- <br /> Item 2 - Culmback Bld�. <br /> Gerry Ervine reviewed the Staff Report as follows oii the application by Dale -� <br /> Miller, 1139 34th Ave., Seattle, WA 98122, for a Variance from Section 19.40.020 � <br /> of Everett AAunicipal Code, Off-Street Parking, for provision of 4 off-street parking <br /> spaces instead of the required 50 in conjunction with the renovation of the existing <br /> Culmback Bidg. at 3015 Colby Ave. <br /> Legal Description: Lots 8 and 9, Block 717, Plat of Everett. <br /> Address: 3015 Colby Ave. <br /> Zoning: B-3, Centra! Business zone <br /> The existing building is of historic significance and was constructed at the time <br /> when no off-street parking was required. it was built in 1924 and has functioned as <br /> a retail use without off-street parki�g for 56 years. The historic significance of <br /> the building is an extraordinary circum;tance that does not generally apply to other <br /> property in the area, and so the Variance is necessary for preservation and <br /> enjoyment of substantial property right. The Variance would not be detrimental to <br /> public welfare since the building has been in use for 56 years without a substantial <br /> impact on adjacent properties. The City's 1972 Halprin Plan calls for improving <br /> and utilizing structures of particular architectural and historic interest in the <br /> downtown area rather than removing them. <br /> I� Dale Miller, the applicant, spoke, saying his major concern is that in their <br /> � application they had asked for a variance of 0 parking spaces rather than the 4 <br /> parking spaces as contained in the staff report to the Board of Adjustment. The <br />� plans they had submitted showing 4 parking spaces in the basement were conceptual <br /> only and they had found that they cannot get 4 legal parking spaces in that area. <br /> Mr. Miller has a purchase agreement on the property. David Branvold, the property <br /> owner, also spoke against requiring 4 parking spaces instead of the 50 as required <br /> by Code. Mr. Branvold also questioned Condition No. 6, that participation in the <br /> program to fund the North End sanitary sewer interceptor be required. <br /> Mr. Ervine responded that all new and converted buildings are required by City <br /> ordinance to pay for the new sewer interceptor lines, and that the condition was <br /> put as part of the Variance as a disclosure for the app!icant. <br /> Frank Wilson stated that since the varianca had been advertised for provision of 4 <br /> off-street parking spaces instead of the required SO, that was what the Board would <br /> have to rule on tonight. <br /> Mr. Zook made a motion to approve a Variance for 4 parking spaces rather than the <br /> required 50 with the Conditions as listed in the Board of Adjustment Report, and <br /> with the stipulation that the application fee would be waived if the applicant <br /> wishes to reapply for 0 parking spaces rather than the 4 as granted tonight. <br /> Frank Wilson seconded the motion and the motion was unanimously passed. <br /> The meeting was adjourned at 8:25 p.m. <br />.r .� ^ �i ! <br /> i <br /> P '� � <br /> Dennis L.
