12 <br /> 30. Hazardous Substances <br /> City warrants to the best of its knowledge that no hazardous substance,toxic waste,or other toxic <br /> substance has been produced, disposed of, or is or has been kept on the premises hereby leased <br /> which if found on the property would subject the Workforce to any damages,penalty,or liability <br /> under any applicable local, state or federal law or regulation. City shall indemnify and hold <br /> harmless the Workforce with respect to any and all damages, costs, attorney fees, and penalties <br /> arising from the presence of any hazardous or toxic substances on the premises, except for such <br /> substances as may be placed on the premises the Workforce,in accordance with section 6 of this <br /> Lease. <br /> 31. General <br /> A. Headings <br /> Titles to sections of this Lease are not a part of this Lease and shall have no effect upon the <br /> construction or interpretation of any part hereof. <br /> B. Successors <br /> All of the covenants, agreements, terms and conditions contained in this Lease shall inure to and be <br /> binding upon the City and Workforce and their respective successors. <br /> C. Entire Agreement <br /> This Lease contains all covenants and agreements between City and Workforce relating in any <br /> manner to the leasing, use and occupancy of the Premises and Workforce's use of the Building and <br /> other matters set forth in this Lease. No prior agreements or understanding pertaining to the same <br /> shall be valid or of any force or effect and the covenants and agreements of this Lease shall not be <br /> altered, modified or added to except in writing signed by City and Workforce. <br /> D. Severability <br /> Any provision of this Lease that shall prove to be invalid,void or illegal shall in no way affect, <br /> impair or invalidate any other provision hereof and the remaining provisions hereof shall <br /> nevertheless remain in full force and effect. <br /> E. Open Occupancy <br /> To the extent required by law, this Building shall be an open occupancy building. <br /> F. Overdue Payments <br /> As a Non Profit 501 (c) (3), Workforce has no provisions to pay late penalty fees under this <br /> Agreement. Workforce shall make every effort to make appropriate payments specified in this <br /> agreement in a timely manner. <br /> 1 `S7 <br /> Page 18of21 <br />
