8 Project: <br /> Change Order no. <br /> Change Order Effective Date: <br /> Work Order UT3076G-Landscaping <br /> Item#300—Force Account. Additional work was required of the contractor above and beyond the work <br /> shown in the plans and specifications. A description of that work is listed below: <br /> • Provide reinforcing steel&thickened concrete section for 59 tree grates. <br /> • Remove sidewalk vent grates&frames at west side of Hoyt next to Yummy Teriyaki. <br /> • Add irrigation work on the south side of Hewitt Avenue Oakes to Broadway. <br /> • Delete irrigation and planting of several tree pits. <br /> • Restore private improvements along Rucker Avenue in Hertz Rental lot. <br /> • Install biobarrier sleeves on the conduit and irrigation penetrations through the biobarrier along the <br /> median strip of Hewitt Avenue. <br /> • Modify the irrigation system as requested by Parks Department @ JJ Hill Park. <br /> • Modify the irrigation conduit,wire&piping run to tree pits and decorative poles. <br /> • Modify conduits @ the mount,modifications to planters&tree guards. <br /> D. Additional Contract Time <br /> Notice to Proceed was issued for Monday,May 20,2002. The Contract allowed 210 calendar days to bring <br /> the project to physical completion;the 210 calendar days from May 20,2002,ends on January 14,2003. <br /> The project was physically complete on February 18,2003. Thirty-five additional calendar days are being <br /> added to the contract as a result of this change order. <br /> On March 25,2003,an agreement between Wilder Construction Company,its subcontractor,A-1 <br /> Landscaping and Construction,and the City of Everett was reached to eliminate issuance of liquidated <br /> damage charges for late work completed by A-1 Landscaping and Construction. The City of Everett is <br /> withholding payment of $10,000.00 in the lump sum bid item#13I —Irrigation Systems Completed,until <br /> the work on the one-year plant establishment plan,(as identified in the March 11,2003 submittal),is <br /> complete. The one-year plant establishment time frame began April 1,2003 and ends on March 31,2004. <br /> Once work on the one-year plant establishment plan is completed the City will forward a letter of project <br /> physical completion,final estimate and final contract voucher for your execution. <br /> By signing this change order both parties agree that no further costs or claims against the City of Everett ' - <br /> will be allowed by the City of Everett for it's adding thirty-five additional calendar days,and that all claims <br /> of liquidated damages will be dropped. <br /> All other provisions of the contract remain in effect. <br /> 21 <br /> Exhibit A <br /> Page 5 of 5 <br />
