The project site <br /> straddles two zones with difTerent Floor Area Ratio (FAR) requirements. This application <br /> is f'or Planning Director's determinati4n of which FAR applies to the proposed <br /> development. <br /> The Planning Direcror, using Review Process ILB, is authorized to "...�pprove, <br /> disapprore or appm��e irilh cnndi7inns lhe use proposed hy Ihe npplicanl" (Subsection <br /> 42.100.B). As a property owner �vithin 300 feet of the subject property, this notice is to <br /> inform you that the Planning Director has issued a determination on the proposed action <br /> as described below. <br /> Background: Proposed is a 10,000 square foot oflice building on a 14, 188 square foot <br /> site. 5, 675.5 square feet of lhe proposed project site is in the B-1 zone and 8,512.5 <br /> square feet is in the R-5 Clinic/OIt'ice overlay zone. The bulk of the proposed ofTice <br /> building will be located in the R-5 C-O overlay zone, �vhile much of the parking area H�ill <br /> be in the B-1 zone. <br /> The main objective for this Planning Director's Determination is to interpret which FAR to <br /> apply to the proposed office development since 0.5 FAR is required for the R-5: C-O <br /> zoned portion of the proposed site, while no FAR is required for the B-I zoned portion. <br /> Authority: Section 41.040 of the Ciry of Everett Zoning Code (EZC) Ordinance <br /> provides for the Planning Director ro "promulgate administrative rules, procedures, and <br /> interpretations consistent �vith the tenns of this Ordinance " <br /> Findings: <br /> . 'fhe proposed ofTice devclopment spans the B-1 and R-5 C-O overlay zones, but is <br /> proposed as a single project. <br /> . The Zoning Code does not provide direction regarding which standards apply where a <br /> single development parcel is di��ided by t�ti�c zoning classification. <br />
