Per EZC §17, the B-1 zone does not have a minimum FAR required for the <br /> proposed ofTice building, but does require a maximwn gross Ooor area of 10,000 <br /> square feet for an ofTice building; ��hile the R-5 GO o�erlay zone per EZC § 16.040 <br /> (D) requires an FAR of 0 5 for ofTice building. <br /> . If the FAR for the R-5 C-O o��erlay zone is used for the ponion of the R-5 zone, (FAR <br /> 0.5 x 8,512 = 4,2�625 square feet), or for the entire project site (0.5 FAR x 14,188 <br /> sq. ft.= 7,094 sq. ft.) the results would sc�erely limit the ma�imum ailo��•able office <br /> building to less than 10,000 square feet. <br /> . The FAR in the B-1 zone is unrestricted. lf such unrestricred FAR for this zone �vere <br /> to apply to this proposal, the resulting building could be substantially larger than the <br /> proposed 10,000 square feet. <br /> . However, the proposed de��elopment is for an ofTice use and the B-I zone contains a <br /> special regulation limiting o(iice buildines to a masimum gross floor area of 10,000 <br /> square feet. <br /> Conclusion: <br /> • Since the Zoning Code does not pro��ide specific dimction on this matter, the Planning <br /> Direcror is authorized to promul�ate an Administrative Rule establishing the <br /> appropriate standards ro be applied <br /> . The Zoning Code contains conflictine st�ndards for the proposed project which is <br /> located on T parcel of land th�t straddles two zones. <br /> . A 10,000 square foot otTice building is permitted in the E3-I zone <br /> . The 10,000 square foot limitation on the size of the o�ce building is the most specific <br /> provision of the Zoning Code �vith regard to the proposed office use. <br /> . Since the B-1 zone allows a maximum gross floor area of 10,000 square feet for such <br /> office buildings, it is loeical and consistent with the Zoning Code to construe this <br /> situation in favor of 10,000 square fooi limitation for the proposed office building. <br /> Decision: Consistent with [ZC .��'�1.040 which authorizes the Planning Director to <br /> promulgate administrative ndes, procedures and interpretetions consistent with the terms <br /> of the City's Zoning Ordinance, it is hereby determined that the FAR interpretation for the <br /> proposed Cobalt Oflice Building �n Colby A�enue shTll based B-1 zone requirement. <br /> Accordingiy, the permitted maximum eross Iloor area for the proposed development shall <br /> be 10,000 square feet for the proposed o(tice building. This inrerpretation applies only to <br /> the proposed Cobalt O�ce building development and is expressly conditioned on the <br />
