The Association shall be responsible for providing and/or paying fur all other fees <br /> • associated with the operation of the program, including, but not limited to, the <br /> payment for officials, instructors, coaches, trophies, printing costs and supplies. <br /> f. A minimum of one launch and an adequate amount of gas available for use by <br /> Association members at all times a shell is in use. <br /> g. Adequate and appropriately trained adult supervision for all events, such as <br /> regattas_ <br /> h. Group membership in U.S. Rowing Association or its equivalent as approved by • <br /> the City to cover all people rowing out of the shellhouse. <br /> i. The Association understands and agrees that the shellhouse facility and all <br /> appurtenances are the sole property of the City. The Association may not change, <br /> modify, or upgrade the structure or building in any way without advance written <br /> approval by the City, (to include painting, additions, utilities modification or any <br /> other activity that permanently changes the facility). <br /> j. Pursuant to availability as discussed in Section 2(d), the Association agrees to <br /> obtain a release of liability prior to allowing non-Association owned watercraft to <br /> he stored in the boating facility. Said release shall be in the form of the Everett <br /> Rowing Association and Personal Boat Owners Boat Stowage Agreement for <br /> Privately Owned Craft which is attached as Exhibit A and herein incorporated by <br /> reference. <br /> k. The Association agrees to operate in a safe and prudent manner and to comply <br /> with applicable federal, state and City ordinances, rules and/or regulations. <br /> 1. The Association agrees to continue to pursue funding for safety equipment. <br /> m. The Association agrees that no duplicate keys will be made. Only personnel • <br /> authorized by the Association will keep keys. Association members needing a <br /> key must request the keys through the Everett Parks Department with appropriate <br /> Association authorization and submission of a signed release in the form <br /> described in section 2(k) above. The Parks Department will keep a list of current <br /> key holders and will provide it to the Association upon request. <br /> • n. If leasehold excise tax is determined to be owed, the Association agrees to pay <br /> such tax including any penalties and interest. <br /> o. Close or restrict rowing operations for the duration of any unsafe rowing <br /> condition (for example, but not limited to. flooding, excessive debris, storm, <br /> unsafe equipment, lack of adequate supervision or any other hazardous <br /> conditions). The City reserves the right to close or restrict the Association <br /> operations at the City's discretion. <br /> 4. Assignability. The Association shall not assign any interest in this Agreement and <br /> shall not transfer any interest in the same. <br /> 5. Insurance. The Association shall take out and maintain insurance in the following <br /> amounts during the term of this Agreement: <br /> 9 <br />
