Criteria and Standards for Review <br />Pursuant to EMC 19.7.020(K), the Hearing Examiner may approve or deny a request for <br />a detached accessory building which exceeds 15 feet in height or 1,000 square feet in <br />area. The basis for the Hearing Examine�'s decision is incompatibility with the principat <br />dwelling and/or neighborhood character. To make this determination, the Hearing <br />Examiner may look to factor which included, but are not limited to: <br />1. �ew obstruction, <br />2. Aesthetic impact on surrounding properties and streetscape, <br />3. Incompatible scale with dwellings on surrounding properties, and <br />4. Impact on neighborhood character. <br />EMC 79.7.020(K) grants the Hearing Examiner the authority to impose greater setback <br />requirements, landscape buffers, or other locational ar design requirements as <br />necessary to mitigate the impacts of an accessory building which is larger or taller than <br />olhenvise allowed by this section. <br />CONCLUSIONS BASED ON FINDINGS <br />The Appiicant requested relief from the standards of EMC 19.7.020(H) which <br />requires that the height of accessory buildings not be greater than 15 feet. <br />Finding of Fact No. <br />2. The Applicant requesied relief from the standards of EMC 19.7.020(B) which <br />requires that the maximum square footage of accessory buildings not be greater <br />than 1,000 square feet. Finding of Facf No. <br />3. The ApplicanQ seeks an exception from the requirements of EMC 19.7.020(fi) <br />and 19.7.020(H) order to construct a two-story 1,352 square foot detached <br />garage to a maximum height of 22 feet 2 inches on property located within the <br />City of Everett at 5108 Colby Avenue. Finding of Fact No. <br />4. Due to the topography of the site, the garage would appear to be a one-story <br />structure and therefore would not impact the aesthetics of the surrounding <br />neighborhood. Based on the iniormation provided in the Record and at the <br />January 25 hearing, there would be no view obstructions from the proposed <br />increase in the garage height. <br />5. The design of the structure would be compatible with the existing residence with <br />a roof pitch similar to that of the principal dweiling and similar or compatible <br />materials utilized for the roof and siding. <br />6. The structure proposed by the Applicant would be approximately 1,352 square <br />feet or 260 sc�uare feet larger than the principal structure.
