_�. <br />PLANNING DIRECTOR DETERMINATION <br />Review Processl #03-003 <br />Landscape Modification <br />� <br />�r�,t��� �� ��� � <br />The City oi Everett Planning Department grants appruvai of a request by Alvin (�: Teri Kieiow, <br />5201 Colby Avenue, Everetl, WA 98203 for a landscape modification for the property �ocated at <br />5201 Colby Avenue, Conaway Motors, with ihe tollowing conditions: <br />Provide a six-foot tall solid board tence along the southern propeny line. This fence shall be <br />dropped to 36 inches in height within fifteen feet of the iront property line. <br />• Install slats in the chain link fence that runs along the east properly line. <br />Provide the landscaping as shown on the approved site plan dated March 7, 2003 on file <br />with the Ciiy Planning Department. This shail include the following; <br />• Instailing an 18' x 9' landscape island at the southwest corner of the site. This area <br />shall be plated with Type III landscaping; <br />• Installing a ten-foot wide landscape strip from the edge of the planter described <br />above east to the security gate, which runs north/south on the property. This area <br />shali be plated with Type III landscaping; <br />• Installing a five-foot wide landscape strip from the security gate along the southern <br />property line to ihe easterri property line. This area shall be planted with Type I <br />landscaping; <br />• Installing Type III landscaping along the northern property line. <br />• Two copies oi the revised landscape plan must be submitted in order to update the building <br />permit application on file with the City. <br />The Planning Director's approval of the �andscape modification �vas based on tha tollowing: <br />The subject property is located in the R-3 zone. The business activity has been certitied as a <br />nonconforming use {NCU #2), since automobile repair is not a permitted use within the <br />residential zone. A SEPA decision was issued on April 8, 1981 for an expar�sion o( the existing <br />nonconforming use (SEPA �91-025); several conditions ot approval were included in this <br />decision, including Iandscapirg and site development. However, ihis expansion was not <br />completed at the time. <br />In spring of 2001 a buiiding additior� was made to the existing ;iructure without the benefit of <br />City permits. A land use approval was issued afler the fact ter the expansion o( a <br />nonconforming use fRev11�01-010). Several conditions were included in this decision, including <br />the need to bring the landscaping on .,ite into conformance �vith code req�irement:. <br />The site is located in a residential zone, and abuts a residential develepment. Section 35.040 oi <br />the Everett Zoning Code requires a minimum of ten feet of Type I or fifteen feet of Type II <br />landscaping for commercial deve;opments, which abut residentially zoned property. <br />Compliance with these code provisions would eliminate a significant amount oi ornsite paricing. <br />Both the applicant and City understand the need for the preservation ef this parking. By <br />installing five teet rather than ten, the parking can be maintained on site, and a bufter can be <br />provided between the subject site and the residential neighbors to the south.
