t —

March 7, 1983
Mr. Robert Miller
7024 Colby Avenue
Everett, Washington 98203
Dear Mr. Miller:

CIT1' OF
everett
.. ,,,,. • :o.e,»
arntrr. wnNRsTaM
oeaoi
The City has received a number of complaints about your liydruplane and equipment storage
occurring on your properties at 7024 Colbv Avenue.
The City of Everett Zoning Code specifically defines an accessory building or use as "... a
use or structure customarily incidental t a permitted principal use or building and located
on the same lot with such principal building:'
Your activity does not c::mply with this definit:on in two significant ways, the first being
that your boat and heavy equipment storage is not customarily incidental to the principal
residential use of the property. This is essentially a commercial activity occurring on a
residentiatly zoned area.
Ir viewing your property and in checking with tlie County Assessor's Office, it was found
that your equipment storage activity is occurring on all three lots you own and is not limited
to the lot your house occupies. Activities that are permitted in the same zone are to be
limited to the lot on which the principal building is located as specified by ihe Code.
Dased on these Code violations, you are required to eliminate all outdoor storage of h.•av
equipment including the hydroplan°, engine parts, tractor, eic. In addition, the outcluor
winch assemblies should be dismantled wich ihe winches used only inside a garage structure.
The clean-up of the site must be completed by April 4, 1983. (Attached for your informatin
is the Penalty Section of the City's Zoning Code.) ,
If you :sagree with the City's position in this matter, this decision can be appealed to the
City Hearing Examiner for a Public Hearing. Pleas^ contact Gerry Ervine in the Planning
D artment at 259-8731 if you havc any questions :egarding the City's position related to
ep
the use of your property.
SinY , ; '. '
,t<, /%'_.'A.'°,
/,,; , .,
Douglas Budden
C ief Building insp Ctor
 ,
 v",zln[i: %;JrtC / __.
nhi£ L: Derickson
Planing Director
DB/DD/sk
Gnc.
cc: Jim isles, Attorney's Office
