8 <br /> AGREEMENT FOR 2004 FASTPITCH WORLD SERIES <br /> This Agreement is by and between the National Softball Association("NSA") whose <br /> address is Box 7,Nicholsville, KY 40356 and the City of Everett("City"), a Washington <br /> municipal corporation whose address is 2930 Wetmore Ave.,Everett, Washington <br /> 98201. <br /> WHEREAS,the National Softball Association considered Western Washington as the <br /> site of the 2004 Girls Fastpitch Softball World Series tournament ("Tournament"); and <br /> WHEREAS,the Tournament is estimated to attract 250-300 division A and B teams, <br /> consisting of ages 10 and under through 18 and under,with 12-16 players per team, in <br /> addition to family members, Tournament officials and umpires who will need lodging, <br /> food and other services during their stay in Snohomish County; and <br /> WHEREAS,the City recognizes the positive tourism impacts and economic benefits of <br /> hosting the NSA Tournament and providing fields for Tournament play; and <br /> WHEREAS, City operates,maintains and schedules playing fields; <br /> WHEREAS, City and Snohomish County, acting through its Tourism Bureau ("Tourism <br /> Bureau") are willing to partner to bring the Tournament to Everett; <br /> NOW THEREFORE, in consideration of the premises and the mutual promises contained <br /> herein,the parties agree as follows: <br /> 1. TOURNAMENT <br /> The NSA will conduct its 2004 Fastpitch Softball World Series Tournament <br /> ("Tournament")on City playing fields as provided in this Agreement. The Tournament <br /> will be held from July 18, 2004 to July 25,2004. <br /> 2. SCHEDULE <br /> A. NSA shall provide the City with a Tournament schedule in writing by May 1, <br /> 2004. This is critical for City staffing purposes. Changes in schedules may increase the <br /> number of staff needed and the City will charge NSA for any additional labor cost due to <br /> such changes. <br /> B. Games may not start earlier than 8 a.m. Games at the Kasch Park complex must <br /> be completed no later than 11:00 PM. Games at Kasch Park may only be played later <br /> than 11:00 p.m. with the approval of the City Maintenance Supervisor or his/her <br /> designee, and the NSA shall be responsible for any additional labor costs resulting from <br /> such late games. The City crew lead assigned to the Tournament has final say with <br /> regard to playing past 11:00 p.m. <br /> 18 <br />
