7. In an R-1A zone, individual lots and clustered housing are permitted. Duplexes are <br /> permitted, and provisions can be made for a condominium on a lot. There are height <br /> restrictions and development envelope limitations for lots in an R-1A zone. (exhibit 1) <br /> 8. In order for zoning change to be allowed within the City of Everett, the criteria of <br /> Everett Municipal Code (EMC) 19.41.160 must be satisfied. The area-wide rezone <br /> must satisfy the following criteria: <br /> 1 . The proposed rezone is consistent with the applicable provisions of the Everett <br /> Comprehensive Plan. <br /> 2. The proposed rezone bears a substantial relation to public health, safety, or <br /> welfare. <br /> 3. The proposed rezone promotes the best long-term interests of the Everett <br /> community. <br /> 9. The hearing on the proposed request was originally set for July 8, 2004. Notice, as <br /> required, was given in the local newspaper; was posted on the subject property; was <br /> sent to property owners within 500 feet of the requested rezone; and was sent to most <br /> of the property owners who are within the rezone. However, it was later determined <br /> that not all property owners within the rezone area were given notice. Therefore, the <br /> July 8, 2004, hearing was cancelled and a new hearing was set for July 22, 2004. <br /> Proper notice, as required, including notice to all of the property owners within the <br /> rezone area, was given. (Wood testimony) <br /> 10. The requested area-wide rezone is consistent with the provisions of the Everett <br /> Comprehensive Plan. It allows for the density of the subject property to be consistent <br /> with the density as permitted in the Comprehensive Plan. It also allows for the subject <br /> property to be developed with housing consistent with that detailed for future <br /> development as set forth in the Comprehensive Plan. (exhibit 1, Wood testimony) <br /> 11 . The proposed area-wide rezone has a substantial relation to the public health, safety, <br /> and welfare of the community. It allows for a previously unusable parcel of land to be <br /> developed in a manner that is consistent with the general character of northern Everett <br /> and does not impact the health, safety, or welfare of the public. (Wood testimony) <br /> 12. The proposed area-wide rezone is in the long-term interest of the City of Everett. As <br /> noted, it would provide housing and redevelopment of a previously contaminated <br /> parcel of land. (exhibit 1, Wood testimony) <br /> 13. In addition to the area-wide rezone request, the Applicant and the City requested that <br /> the maximum design standards for the development as contained in the Community <br /> Renewal Plan be adopted. The Everett Housing Authority has submitted a proposed <br /> Community Renewal Plan for the Everett Smelter Redevelopment Area (exhibit 6) that <br /> provides a complete narrative of the scope of the plan.
