Bigelow Creek is an Environmentally Sensitive Area and cannot be altered <br /> or developed unless the provisions of EMC Chapter 19.37 are followed. <br /> The Appellants' action in clearing the south slope of Bigelow Creek was <br /> not consistent with this ordinance. (findings 1-13) <br /> DECISION <br /> Based upon the preceding findings of facts and conclusions as set forth above, <br /> the following Order is issued: <br /> 1. John A. and Pamela E. Arendt are in violation of the provisions of EMC <br /> Chapter 19.37 and the Environmentally Sensitive Protective Covenant <br /> entered between the City and John A. and Pamela E. Arendt on August <br /> 31, 1998. <br /> 2. John A. and Pamela E. Arendt shall be fined $500 for said violations. The <br /> $500 fine shall be suspended upon compliance with this Order. <br /> 3. John A. and Pamela E. Arendt shall abate all violations of EMC Chapter <br /> 19.37 on the property located at 2210—49th Street SE, Everett, <br /> Washington. <br /> 4. John A. and Pamela E. Arendt shall prepare an approved planting plan for <br /> the south steep slope and stream buffer of Bigelow Creek. The plan shall <br /> be simil r to the August 13, 1999, Wetland Resources Plan for the north <br /> slope. T e plan shall be submitted to the City for approval. <br /> 5. John A. and Pamela E. Arendt shall be required to implement the <br /> approved planting plan for the south slope. The plan and the <br /> implementation shall include stabilizing the steep slope above the buffer <br /> with approved groundcover. <br /> 6. John A. and Pamela E. Arendt shall not commit any further violations of <br /> EMC Chapter 19.37. <br /> 7. All cleanup and abatement of the violations, including the submittal of the <br /> planting plan and the implementation of the plan, shall be completed by <br /> May 15, 2000. <br /> 8. If John A. and Pamela E. Arendt fail to abate the identified violations as <br /> directed by this Order, the City of Everett is authorized to undertake and <br /> complete the abatement in conformance with the provisions of the Everett <br /> Municipal Code, Chapter 1.20 at the full expense of the Appellants, and <br /> 7 <br />
