<br /> This Agreement shall not be construed as an assumption by the County,the City or OPL of
<br /> any authority, responsibility or liability with regard to the design,construction, repair,
<br /> maintenance, or operation of PSE's electric transmission lines nor shall the design,
<br /> construction, repair, maintenance, or operation of the electric transmission lines be considered
<br /> a joint undertaking, partnership,or joint venture by PSE and the County,the City or OPL.
<br /> City Water Transmission Line. The City owns and operates Water Transmission Line
<br /> No.5 located within easements crossing property owned by the County within former
<br /> Drainage District No. 6 in Snohomish County. The City retains sole authority and
<br /> responsibility for the design,construction, repair,maintenance, and operation of its water
<br /> transmission line before,during and after the maintenance activities undertaken pursuant to
<br /> this Agreement. This Agreement shall not be construed as an assumption by the County,
<br /> PSE or OPL of any authority, responsibility or liability with regard to the design,construction,
<br /> repair, maintenance, or operation of the City's water transmission line nor shall the design,
<br /> construction,repair, maintenance,or operation of the water transmission line be considered a
<br /> joint undertaking, partnership,or joint venture by the City and the County, PSE or OPL.
<br /> OPL Petroleum Pipeline. OPL owns and arranges for the operation of a petroleum
<br /> pipeline located within easements crossing property adjacent to property owned by the
<br /> County within former Drainage District No. 6 in Snohomish County. OPL and its operator,
<br /> currently BP Pipelines(NA), retain authority and responsibility for the design, construction,
<br /> repair, maintenance, and operation of its petroleum pipeline before, during and after the
<br /> maintenance activities undertaken pursuant to this Agreement. This Agreement shall not be
<br /> construed as an assumption by the County, the City or PSE of any authority, responsibility or
<br /> liability with regard to the design, construction, repair, maintenance, or operation of OPL's
<br /> petroleum pipeline nor shall the design, construction, repair, maintenance,or operation of the
<br /> petroleum pipeline be considered a joint undertaking, partnership, or joint venture by OPL and
<br /> the City, the County or PSE.
<br /> County Property. The County owns real property located within former Drainage
<br /> District No. 6 in Snohomish County. Located upon this property are flood control and
<br /> associated drainage facilities constructed by the former Drainage District. The County's
<br /> property is subject to easements granted to PSE and the City for their electric and water
<br /> transmission lines respectively. - -
<br /> 2. TASKS COVERED BY THIS AGREEMENT
<br /> The Tasks performed under this Agreement shall be broken into three classifications: a.)short
<br /> term maintenance, b.)on-going maintenance, and c.)unforeseen or catastrophic failures
<br /> (collectively referred to herein as"Tasks").
<br /> A. Short term maintenance. Consistent with an inspection of the Facilities on September 22,
<br /> 2003 by Snohomish County,the following maintenance will be undertaken in the corresponding
<br /> time frames:
<br /> • Cross-dike culvert and tidegate. This pipe is partially rusted through the bottom, allowing
<br /> water to enter at high tide. Pipe should be replaced, or slip lined to prevent water
<br /> entering the landside ditch behind the dike.
<br /> Estimated cost for full replacement: $80,000
<br /> Estimated time for completion of task if work commences by 8/30/04: 9/30/04
