LEASE AMENDMENT No 2 <br />THIS AMENDMENT is executed this day of '2004, by <br />and among Everett, Professional Properties, "Landlord" and City of Everett, "Tenant". <br />RECITALS <br />A. Landlords predecessor in interest, by that certain Lease dated July 30, 1993 <br />leased to Tenant certain real property located in Everett, Washington and <br />premises address of 2730 Colby Avenue, Everett, Washington, 98201. <br />B. On December 15, 2002, the Landlord and Tenant entered into Lease <br />Amendment No. 1 to extend the lease term for one (1) year with the option to <br />extend the term for an additional one (1) year. <br />C. Tenant and Landlord hereby express their mutual desire to renew the lease <br />agreement and to amend, by this writing, those terms, covenants and <br />conditions contained herein. All terms and conditions of the Lease not <br />expressly amended by this writing shall continue in full force and effect <br />throughout the renewal term. <br />NOW, THEREFORE, for good and valuable consideration, the receipt and <br />sufficiency of which is hereby acknowledged, it is hereby agreed as follows: <br />1. Commencement and Term: The renewed term shall commence <br />contemporaneously with the expiration of the existing lease term. The <br />renewed lease term shall be for a period of two (2) years. <br />2. Rental Payments: Notwithstanding anything to the contrary in the lease <br />document, the new base rental shall be as follows: <br />TERM <br />MONTHLY RENTAL <br />10-1-04 thru 9-30-06 Gross Monthly Rent $9,462.00 <br />3. Option: The lessee shall have the option of extending the lease for two (2), <br />one-year terms ("Option Term One and Option Term Two") by providing the <br />lessor with a written notice 90 days prior to the expiration of the current <br />extension and option term one. The option shall be at the same terms and <br />conditions of the lease dated July 30, 1993 with the exception of the rent, <br />which shall be $9,462.00 per month. <br />S:\CFullert\Projects\Policeevidenceleaseadden2004.doc <br />
